A few months before the presidential election, the 35 hours are back in the debate. The UMP should provide, at its convention started on Tuesday, returning to the reduction of working time negotiated by Martine Aubry in 2000. According to the Minister for Ecology, Nathalie Kosciusko-Morizet, the majority party would provide an opportunity for partners to open branch agreements on the subject. Objective: To renegotiate the legal working time by sector. "There are industries in which the 35-hour sustained pose problems, despite the flexibility we have made, [...] areas where it is more complicated than others, where the division of labor is much less homogeneous in others, "said the minister this morning on LCI.

The method, a general law on working time does not seem to agenda. The Secretary General of the UMP, Jean-Francois Cope, has thus also opposed, on Tuesday in La Voix du Nord, "an arbitrary law" on the back 35 hours. "The issue of working time should not be a taboo [...] but do not do anything. Working time should be determined by industry or company, with the social partners. We do not work the same way in construction, food processing, nuclear power, "he said. A position consistent with the wishes of the MEDEF. The employers' association had called in January the government to "trust the social partners". "The concept of a legal term that would be the same for everyone and all the time is obsolete."

"The release of 35 hours is inevitable"

The goal, however, is clear. For the majority party, back in one way or another about 35 hours is a must.

(From our special correspondent in Athens)

Ten days after a summit of the European Union has offered a new and generous aid package (130 billion of soft loans and additional deletion of 50% of its bank debt), Greece has still failed to respond positively to its European partners. The ongoing political chicanery in Athens are now exasperated the northern Europeans. Former German Chancellor Gerhard Schröder has just said out loud what they think almost all of his compatriots: "Greece should never have been back in the euro area! ".

Four days after returning from Brussels summit, Greek Prime Minister George Papandreou announced unexpectedly that he would submit to a referendum history of the Europe Agreement on October 27.In his speech before the vote, Prime Minister pledged to work towards forming a national unity government, which would then be able to obtain approval from the European level by a qualified majority of the Greek Parliament.

Saturday at midday, Papandreou has therefore gone to the President of the Hellenic Republic (with powers more symbolic than real, like the presidents German or Italian), asking him to convene the party leaders in for the formation of a grand coalition. But Antonis Samaras, the leader of opposition party New Democracy (center right) then stated publicly that he demanded the resignation prior Papandreou, in his eyes too discredited claim to form such a government of national unity.

Creditor banks in Greece will have to accept losses "substantial" in the new bailout of the country, warned Saturday that the European Ministers of Finance. Last night, the central bankers of the euro zone had "agreed to say that we had to have a substantial increase in the contribution of banks" in the form of a depreciation of their claims, said the leader of European finance ministers, Jean-Claude Juncker.

According to diplomatic sources, the ministers agreed to effectively negotiate with the banks at a discount of "at least 50%" against a target of 21% decided on July 21 with the banking sector. They thus de facto endorsed the conclusions of an expert report which was presented by the troika of donor funds in Greece (EU, ECB and IMF).The paper believes that a discount of 50 or 60% hope to stabilize Greece without having to increase in the amount of gigantic international loans that have already been promised.

A "discount" is the term used in relation to the financial depreciation of the value of loans taken by creditors in this case private banks and investment funds that hold government debt. A discount of 50% borne by the private sector, the second program of financial support pledged July 21 to Greece, however, should be slightly revised upwards with government loans (Europe and IMF) to 114 billion euros, against 109 billion euros. To maintain the envelope of 109 billion euros unchanged, it would bring the discount to 60%, according to calculations by experts.

• Banks recapitalized to the tune of 100 billion euros

In any event, the second bailout in late July, just after the first amounting to 110 billion euros agreed in spring 2010, will have to be redesigned. "It's pretty clear that we need a substantial discount on Greek debt," also said Saturday the Swedish Finance Minister Anders Borg on his arrival in Brussels for a meeting with colleagues from across the EU."We will now work on a new plan Greek, there is an effort of European countries [to, ed] and will also require an effort of the private sector," said his Belgian counterpart Didier Reynders.

The question is whether the banks that have so far dragged its feet to give the pot, will accept a negotiated settlement does not pass through a default of Greece said "messy" serious consequences. "It's a negotiation s'entame," said Didier Reynders. These discussions, held in Brussels with representatives of the Institute of International Finance (IIF), the banking lobby, "still, there is no agreement yet," said a source told AFP familiar with the matter.

In return for the effort required on the Greek claims, it is intended to recapitalize European banks to the tune of nearly 100 billion euros. The subject was Saturday in the agenda of the ministerial meeting.According to sources cited by Reuters, an agreement in principle was reached by European finance ministers on the recapitalization faxless pay day loans. European diplomats interviewed by AFP were less categorical in the late afternoon. "There is no agreement on the recapitalization, it gets stuck a little." According to one of these diplomatic sources, "Spain insists on having a comprehensive, not only on the recapitalization of banks but also on strengthening the European Financial Stability Fund (EFSF). " On the other hand, "the ministers are trying to agree on the minimum capital."

The European Banking Authority (EBA) has proposed that banks reach a level of capital of 9% by mid-2012.A diplomat acknowledged that some countries in the viewfinder of the markets, like Italy, Spain or Portugal, feared that the recapitalization will further undermine public finances.

• The Fund will not support a bank

Moreover, the French proposal to grant a banking license to the Fund support the euro area (EFSF) so he can refinance with the European Central Bank "is no longer on the table," said Minister Dutch Finance Jan Kees de Jager. Only two options are being discussed to increase the firepower of the device, he told reporters Saturday. These two tracks on the agenda now that the mechanism acts as a partial insurance of the public debt of countries in difficulty or higher participation of the IMF to the device, according to a German government source. But there is "significant differences between countries" on the issue, said Jan Kees de Jager.

How to leverage the capacity of the EFSF was the main sticking point between Berlin and Paris at the approach of the EU summit. France, worried about its budget deficit and are "triple AAA" prefer tap into the existing European funds, starting with the ECB. Germany, also sensitive to the separation of powers as inflation risks, refuses anything resembling a crisis by printing money in Europe. France was not only to advocate the involvement of the ECB, arguing that this system worked very well in the United States or Great Britain. She was supported by Spain, Italy or Belgium.

The European Relief Fund currently has a lending capacity of 440 billion euros, part of which is already committed for Ireland and Portugal. This envelope is considered insufficient to prevent contagion of the debt crisis in countries as large as Italy and Spain, increasingly in the firing line of credit rating agencies. European countries negotiate so hard for weeks on the best way, via a "leverage" to multiply by up to five response capacity of the Fund's financial debt of fragile countries.

The gray economy and softness unusual ambient temperatures may have caused consumers to be cautious in September. Including their clothing purchases. Accordingly: in France, sales of textile and clothing tumbled 10% from the same month last year. This is the French Institute of Fashion (IFM) that will sound the alarm in his last letter of conditions.

This drop in sales spares no distributor:

-Department stores as well accuse a sales decline of 7% in value in September, compared to the same period in 2010,

-Chains saw sales backward 10%

-The decline in sales is 12% for independent multi-brand and 14% for Monoprix.

Monoprix, it was confirmed that the "weather is unfavorable, has had an impact on sales", but also justifies the bad news by the fact that the month of September 2010, compared, was a great month, "sales were then actually up 7%, "says the distributor is.The postponement of a commercial called "The nine days', held in September last year but this year is set astride September and October, may have also contributed to falling sales, recognizes we also Monoprix.

The worst September for a long time …

As for independent multi-brand, the drop in sales was certainly 12% in September, but the segment of the lingerie was displayed, according to the IFM, the best resistance (+ 0.3% in value in September).

All distributors alike, sales began to level off in the summer, the balances have been very disappointing for retailers.During the period January-August 2011, they had already declined by 1.7% in value over the same period last year.

The downward trend has clearly intensified in September, which is the worst for the industry for a long time: according to the IFM, clothing sales in France had indeed increased 2% in 2010, which was a good year, after falling 8% in 2009. But they climbed 1.2% in 2008 and even 8.3% in 2007.

The outlook for the month of October are not provided completely obscured: true, according to Franck Delpal, an economist at the IFM, a slight improvement in weather clothing is not excluded in October, with relapse of temperatures .Already, the last weekend of September would, he said, was marked by an upturn in sales, including warm clothing.

What is the country with the largest trade surplus? Germany, with 194 billion dollars over the last twelve months, ahead of China (173 billion). What is the state that attracts the most capital of the world? The Netherlands, where foreign direct investment to date some 3000 billion, far ahead of the United States (2.25 trillion), according to the review of the IMF. What is the country which hosts the most tourists? France has received 78.9 million last year, against 61 million for the United States.

Each of these expresses a form of performance excellence. Germany feeds her flawless manufacturing tradition since the industrial revolution. The Netherlands, taxation deliberately advantageous for multinational companies, is one of the hubs of global capitalism since its "golden age".The Hexagon cultivates an image of cultural universality and good living. Taken one by one, most Old World nations are doing much better than the European Union, or the idea of it.

The Americans accused him of set themselves up as "fortress" when "big market" Europe was created in 1992. Now she is unable to defend its weak links, as révèlela sovereign debt crisis. Public deficits are, however, generally two to three times lower than those of the United States and Japan, as Jean-Claude Trichet, ECB president, continues to say. But markets look weak countries, not the average of a "Union" in front.

Europe is becoming "the global village idiot" in the words of Hubert Védrine, former foreign minister. He who has not grasped the rules and fails to protect its interests. This is particularly evident in relations with China, became the first trade and investment partner of the Old Continent. The EU has a trade deficit with China of 169 billion (in 2010) of similar magnitude to balance US-China (205 billion euros). But the complaints vis-à-vis Beijing are very far from achieving the shouts of Washington. The Committee of Foreign Trade of Parliament held on October 11 a special session on Sino-European trade. As responsible for relations with the Far East in the European administration, Helena König wanted to do things in perspective: "It is clear that for European companies in China is a source of profits" at she said, with emphasis on German and French companies in China. Certainly.

Unfair competition of the "Made in China"

This can not hide everything no fax cash advances. First of all the unfair competition of the "Made in China", which led last week the U.S. Senate to vote for the first time, a bill accusing Beijing of "manipulating its currency." Or access the Chinese market, fully controlled, as we see "a rush of China in Europe." This is the title of the study that came to write scathing François Godement Jonas Parello-Plesner and for the European Council on Foreign Relations. They describe an all-out acquisition strategy. The recovery of ailing brands such as Volvo and MG in the car, the establishment of SMEs. Beijing has established a fund of 2.8 billion euros to assist innovative German SMEs to develop partnerships with their Chinese counterparts. This may take the form of real industrial cities, as in Florence, on the outskirts of Florence, where 4 800 small businesses employing 40,000 Chinese expatriates in Mainland China are a bridgehead offshore.

Faced with this wave, "Europe has no information or regulations," stigmatizes Francois Godement. The Bulgarian ambassador in Paris, Marin Raykov, explains how his country, not having been able to interest the French car manufacturers, has brought the Chinese Great Wall Motor to manufacture cars in Bulgaria.Deindustrialization and fiscal difficulties of the southern states are an ideal soft underbelly.

With its 3.2 trillion (dollars) of foreign exchange reserves, Beijing appears in turn as the white knight to the rescue of Greece, Portugal, Ireland and Hungary. Last summer, a delegation from the Italian Treasury, modern-day Marco Polo, visited with great ceremony in Beijing to his court. It was rumored that the Chinese central bank holds 25% of all European public debt. Information without foundation, insists Francois Godement. Unlike the U.S. Treasury, following precisely the holding of Treasury bonds by Beijing and publishes its figures, Europe has no statistical tool.Like Greece, which has Eurostat in September 2004 that its accounts were rigged, had not a lesson.

This lack of information is a godsend for Beijing, which keeps his secret. What easy conquest, according to the principle of "divide and rule", as old as the Roman Empire, the British had returned to their use to colonize the Middle East.

How to help her children buy a home? Faced with soaring prices of the stone, more and more parents are wondering. For young people without a little help family, buy a property is often difficult. But the stone is more than ever the key to any well-constructed assets.

A DONATION as a financing

With the recent reform of the taxation of wealth, each parent can give full tax-free, but every ten years now, up to € 159,325 (reduction in force in 2011) to each child or € 318,650 for a couple . And if the child is an adult, he took advantage of an additional allowance of 31 € .865 (per parent under 80 years), allowing it in the end, even in the capital, to acquire a lovely pied-a -land …A strategy that offers the advantage of not "inflate" its own property portfolio, since it is your child immediately becomes sole owner of the property. Thus, it can allow parents to avoid the wealth tax if the value of their taxable net wealth falls short of 1.3 million euros, or to play down if it does not exceed 3 million euros.

This approach has its drawbacks, however. "A coming of age, the child who has de facto full ownership, may sell at any time, even if the parents object," says Brillat Michel, director of engineering heritage of the EU Financial France. To "block any attempt inappropriate," Louis Aussedat, notary Althémis Network, advises the inclusion in the deed of gift, and in the deed of purchase, a prohibition to alienate. This provision makes the sale to the agreement of parents.

Know that it is still quite possible to do this for the benefit of a minor, but we must in this case the approval of the guardianship court. And while the child is under 18, the slot is part of global real estate portfolio of his parents, with possible consequences in terms of ISF.

To a lesser extent, if you own a home savings plan, you can send your borrowing rights to your child, provided that it is itself the holder of such a plan (open for at least 3 years) business card. Finally, give money in advance and not a property which you would already own, you can be exempt from land registration fee (0.715%).

SEND ACHETERET in a SCI

Here is the real estate company (SCI) who acquires the home and not you and / or your children directly, thus, again, to fund and pass more easily again. Parents are partners and own the shares of the SCI. A major advantage of this legal structure is its flexibility. A condition of relying on a notary or a lawyer to draft the statutes (beginning approximately € 2,000), all management schemes, or nearly so, may indeed be calmly considered: full or bare ownership only given to children, in whole or in part, etc..Parents may reserve the role of manager to get their hands on the decisions and procedures to meet the requirements (general meeting …). "In this configuration, the children, even adults, can not sell without your consent," said Gilles Etienne, Partner at Cyrus Council. The SCI can also borrow, even if minor children are involved. Only requirement: well set, with the help of a professional, their responsibilities vis-à-vis the debt and obtain the consent of the judge. Finally, the very existence of an ICS is not limited in time and value, as the designation of heritage that can be managed, is not fixed.

Scellier Act: rent-to-child

Parents who buy a home with the benefit of the tax reduction under the law Scellier can rent the apartment to their children.A three conditions: it must be the principal residence of the latter, that it is detached from the tax home of the parents (it is then placed on its side), finally, that actually pays the rent.

AND THREE! One by one the major French banks are going to Canossa and sacrifice to market a "piece" of their balance sheets. Faced with an earthquake and a tsunami regulatory markets, BNP Paribas, Societe Generale and Credit Agricole have now decided to haul down the wing, to reduce their credit or financial markets, so their ambitions.

Regulatory side, it is the new international financial rules – dubbed Basel 3 – exercising tremendous pressure. Before Basel 3, the balance of a bank should respond to a simple rule: for every 100 euros of assets, a bank must prove four euros of capital. Basel 3 is that floor to 7.50 euros (10 euros for the world's largest banks). In fact, walking is even higher, partly because the definition of capital has become more restrictive, because the requirements were noted in respect of the riskiest activities.

To comply with new rules, banks can either raise capital or reduce their activities. Until recently, they preferred the first option would have boosted capital by 2019 – the date of entry into force of Basel 3 – with the setting aside of the results and payment of dividends. It will actually go much faster – the Banque de France demands to be ready in 2013 – and in crisis. But the crisis, precisely, will weigh on results, and thus the ability to create capital.

An alternative course would be to raise fresh capital. But a capital increase – if it manages to attract investors very defiant towards the banking sector – would result, at the current share price, an unbearable dilution of existing shareholders, already battered.

There is therefore now no real choice but to reduce activity. What, specifically, means that Societe Generale, BNP Paribas and Crédit Agricole – like many others who have less news on the topic – "have both feet on the brake," says one industry expert small personal loans.

This has more or less impact. The political and financial authorities do not necessarily see a dim view that banks are reducing their market positions. They are more worried about the air pocket that is beginning to be felt on the structured credit or term loans, such as local authorities.

Three resources

But banks now have even less choice than the decrease in activity is also the most effective response to be made to the current liquidity crisis. Specifically, a bank finances its operations with three main resources: its capital, deposits and customer loans on the market, often for at least half of the balance sheet.

Or, take the market has become difficult and expensive. Difficult, because the widespread suspicion that affects the euro area discourages lenders from around the world to take risks, especially in respect of a banking sector by definition exposed to the debts of States.

Unable to borrow simply, banks have other options, more expensive, such as getting loans secured on assets. But again, the possibilities are reduced with the market value of assets.A good state of Italian example is now much less a guarantee that a few months ago. Moreover, if indeed it is … Every time a customer credit rating deteriorates a sovereign, then it erodes the capacity of refinancing of banks that hold. In this context, banks borrow more short-term before (which makes them more vulnerable) and more expensive, which degrades their margins, so their profits and their ability to produce new capital. Full circle …

The Fed has launched "Operation Twist" on Wednesday. Following a two-day extraordinary meeting of its Monetary Policy Committee (FOMC), the U.S. central bank announced its intention to sell by the end of June 2012 for $ 400 billion of treasury bills maturity of three years or less, to buy an equivalent amount of maturity from six to 30 years.

This mechanism, which takes its name from the famous dance that was all the rage in the 1960s, had just been used for the last time in 1961. Its objective is to reduce interest rates in the long run to give a boost to business investment and the demand for housing loans, which use these rates as reference.

The Fed, however, chose not to touch interest rates that determine the short-term rates. They remain between 0% and 0.25%.And they will remain at historically low levels until mid-2013, said a statement.

Market disappointment

In addition to this twist, and in order to support the mortgage market, the Fed will also buy real estate securities without increasing the size of its portfolio. For this, it will continue to reinvest the securities-backed real estate it owns as they fall due. But the FOMC said, instead of buying Treasury bonds as it did previously, she will buy securities backed by mortgage-agency mortgage refinancing para as Fannie Mae and Freddie Mac.

This double operation shows that the Federal Reserve, the economy remains very depressed."The latest economic indicators suggest a continued weak conditions in the labor market and unemployment remains high, the Fed said. There are significant downside risks weighing on economic prospects, including strains in global financial markets. " These findings are similar to those of the IMF, which announced Tuesday it had seen very sharp fall in its growth forecast for the U.S., in theory at a level insufficient to expect a decline in the unemployment rate, which remains very high, to 9.1%.

On Wall Street, where the launch of Operation Twist was widely anticipated, the operators retain the discretion not optimistic the U.S. economy. Shortly after the news release of the Fed, the Dow Jones, which evolved in equilibrium has shifted into the red.It closed down sharply from 2.49% to 11,124.84 points.
